go back to Topic: [Illegal Schools](https://phuket.school/s/phuketschool/wiki/Illegal+Schools "Illegal Schools") ## **Letter to the Ombudsman in Thailand** written by the Damrong Dhamma Center after a meeting with legal school owners at the Damrong Dhamma Center at Salagan Phuket. —- วันที่ ๑๕ สิงหาคม ๒๕๖๗ เรื่อง ขอความเป็นธรรมและตรวจสอบข้อเท็จจริงการละเว้นการดำเนินการของเจ้าหน้าที่รัฐ ### เรียน เลขาธิการผู้ตรวจการแผ่นดิน ข้าพเจ้ากลุ่มผู้ประกอบธุรกิจโรงเรียนอนุบาล ได้รับความเดือดร้อนจากการที่ชาวต่างชาติ เช่น ชาวรัสเซีย เข้ามาประกอบธุรกิจเปิดโรงเรียนอนุบาล หรือ ธุรกิจนอสเซอร์รี่ โดยไม่ได้รับอนุญาต ไม่เสียภาษี ไม่มีการจ้างงาน แย่งอาชีพคนไทย ในลักษณะเช่าบ้านเป็นหลังแล้วเปิดโรงเรียนรับเลี้ยงเด็กไม่ได้รับอนุญาต และไม่มีครูวิชาชีพดูแล ซึ่งมีการร้องเรียนจำนวนหลายครั้งแล้ว เจ้าหน้าที่ไม่ดำเนินการอย่างจริงจัง ทำให้ผู้ประกอบธุรกิจที่ถูกต้องตาม กฎหมายได้รับผลกระทบอย่างมาก และเกิดความท้อแท้ในการดำเนินธุรกิจ ซึ่งมีประเด็นข้อสงสัยขอให้ท่านช่วยแหลือ และตรวจสอบ มีรายละเอียด ดังนี้ ๑. โรงเรียนอนุบาลที่เปิดโดยไม่ได้รับอนุญาต มีมาตรการลงโทษอย่างไร ๒. โรงเรียนอนุบาลที่เจ้าหน้าที่ไป ตรวจแล้วพบว่าไม่มีใบอนุญาต แล้วขออนุญาตในภายหลัง ลงโทษอย่างไร และใช้เวลาในการอนุญาตกี่วัน เพราะจากที่ตรวจสอบพบว่าโรงเรียนที่อยู่ระหว่างอนุญาตใช้เวลาเป็นปีกว่าจะได้รับ อนุญาต เพราะหากจะให้ถูกต้องตามกฎหมายโรงเรียนควรถูกปิด เมื่อได้รับอนุญาตจึงจะต้องเปิดโรงเรียนได้ มิใช่เปิด โรงเรียนไปด้วยขออนุญาตไปด้วย ไม่เป็นธรรมกับโรงเรียนที่ทำถูกกฎหมาย ควรจะมีการกำหนดช่วงเวลาที่อนุญาตให้ ชัดเจน ๓.โรงเรียนที่ได้รับอนุญาตเพียง ๑ แห่ง แต่ใช้ใบอนุญาตดังกล่าวไปเปิดโรงเรียนสาขาเพิ่มเองโดยไม่ได้รับ อนุญาต ควรได้รับการลงโทษอย่างไร ๔. โรงเรียนที่เปิดโดยไม่ได้รับอนุญาต ไม่มีครูคนไทยที่มีวุฒิบริบาล หรือปฐมวัย มีลักษณะเปิดโรงเรียนแล้ว ดูแลนักเรียนสอนกันเองในครอบครัว ไม่มีใบอนุญาตทำงานใดๆ ทั้งสิ้น ๕. โรงเรียนที่ไม่ได้รับอนุญาตเปิดรับเลี้ยงเป็นรายวัน รายสัปดาห์ และรับเลี้ยงเด็กแบบค้างคืน ซึ่งผิต กฎหมาย ๖. บางโรงเรียนเลี่ยงบาลี ใช้คำว่า "Kids Club" ไม่ได้คำว่า นอสเซอรี่ หรือโรงเรียนอนุบาล เพราะอ้างว่า รับเด็กมาเล่นด้วยกันมิได้มีการเรียนการสอน ไม่จำเป็นต้องได้รับอนุญาต ซึ่งตามกฎหมายการเลี้ยงเด็กตั้งแต่ ๕ คนขึ้น ไปต้องมีใบอนุญาต พวกข้าพเจ้าเห็นว่าการเปิดโรงเรียนอนุบาลแบบไม่มีหน่วยงานตรวจสอบ เป็นผลให้เกิดธุรกิจประเภทนี้มาก ขึ้น รัฐเสียหายไม่สามารถเก็บภาษีได้ ความปลอดภัยของเด็กไร้ผู้รับผิดชอบหากเกิดปัญหาขึ้นมาเพราะโรงเรียนไม่มี ประกันและไม่ครูผู้มีใบประกอบวิชาชีพ นี่คือปัญหาใหญ่ที่ภาครัฐมองข้าม ข้าพเจ้าประสงค์ให้ท่านช่วยเหลือ สั่งการ ให้หน่วยงานที่เกี่ยวข้องเช่น สำนักงานศึกษาจังหวัด พมจ. ตำรวจตรวจคนเข้าเมือง สำนักงานคุ้มครองแรงงานและ สวัสดิการแรงงาน ที่เป็นผู้ถือกฎหมายบังคับใช้กฎหมายในการปราบปราม และผลักดันผู้กระทำผิดที่ไม่ยำเกรง กฎหมายไทย เพราะบางโรงเรียนได้เปิดโรงเรียนไม่ถูกกฎหมายมาเป็นเวลานานก็ยังคงประกอบธุรกิจอยู่ เช่น โรง เรียน —- **Date:** August 15, 2024 **Subject:** Request for fairness and investigation of state officials’ neglect of duty **To:** The Secretary-General of the Ombudsman I, as a representative of kindergarten business operators, have faced difficulties due to foreign nationals, such as Russians, coming to establish kindergarten or nursery businesses without authorization, without paying taxes, without proper employment, and taking jobs away from Thai people. These foreign operators rent houses and then open unauthorized childcare facilities without qualified teachers supervising. Despite numerous complaints, the authorities have not taken serious action, which has significantly impacted lawful business operators and caused great discouragement in conducting our businesses. I request your assistance and investigation on the following matters: 1. **What are the penalties for kindergartens operating without authorization?** 2. **For kindergartens that have been inspected by the authorities and found to have no license but then apply for one later, what are the penalties?** How long does it take to obtain a license? From our examination, it takes more than a year for kindergartens to be granted a license. To comply with the law, kindergartens should be closed until they receive their licenses. It is unfair to lawful operators when some institutions remain open while simultaneously applying for licenses. There should be a clearly defined timeframe for granting licenses. 3. **What should be the penalties for kindergartens that are licensed for only one location but use that license to open additional branches without approval?** 4. **What are the penalties for kindergartens operating without a license, that have no Thai teachers with appropriate qualifications in early childhood or nursery education, and that simply supervise children in a family-style setting without any work permits?** 5. **Some unauthorized kindergartens provide daily, weekly, and even overnight childcare services, which is illegal.** 6. **Some institutions evade the law by using terms like "Kids Club" instead of "Nursery" or "Kindergarten," claiming that they merely provide playtime for children without teaching, and therefore do not require a license.** However, according to the law, any facility caring for five or more children must have a license. We believe that the unchecked operation of unauthorized kindergartens has led to the proliferation of this type of business. The government suffers as it cannot collect taxes, and there is a lack of responsibility for the safety of children, especially if an issue arises because these institutions do not have insurance or qualified teachers with professional licenses. This is a major problem that the state has overlooked. I request your assistance in ordering the relevant authorities, such as the Provincial Education Office, Provincial Social Development and Human Security Office, Immigration Bureau, Labor Protection and Welfare Office, and other legal enforcement agencies, to take strict legal action against those who disregard Thai laws. Some of these schools have been operating illegally for a long time, yet continue to run their businesses, such as certain schools.
